ecoLiving offers Energy Certification services for residential units and small commercial buildings or units, under Decreto-Lei n.º 101-D/2020 of 7 December, in its current wording.
1. Acceptance of Terms and Conditions
These terms and conditions govern your use of the ecoLiving.pt website, including all content, features and services offered through it (collectively, the “Website”).
By accessing or using the Website, the user agrees to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, you should not use the Website.
2. Changes to Terms and Conditions
We reserve the right, at any time and without prior notice, to change these Terms and Conditions. By using the Website following the posting of any changes to the Terms and Conditions, you agree to be bound by the updated Terms and Conditions.
3. Copyright
The Website and all content and materials included therein, including, without limitation, the design, layout, logos, brands, text, images, graphics, software, codes and other materials (“Content”), are protected by intellectual property rights and other applicable laws.
You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, publish, transmit or otherwise exploit any part of the Content except as expressly permitted by the Website owner.

ecoLiving is not responsible for any damages or losses resulting from the use or inability to use the Website, including, without limitation, any direct, indirect, incidental, or similar damages. It is also not responsible for errors due to system irregularities or website failure.

The user may use the Website only for legal purposes and in accordance with these Terms and Conditions. You agree not to use the Website, including, without limitation:
- In any way that violates any applicable law or regulation;
- In any way that may harm the Website or its performance;
- To collect information from other users without their express consent;
- To transmit unsolicited or unauthorized advertising;
- To send, receive, upload, download, use or reuse any material that does not comply with these Terms and Conditions;
- To transmit any viruses or other material that is malicious or technologically harmful.
6. Privacy Policy
Use of the Website is subject to the Privacy Policy which is available at the link to privacy policy. By using the Website, you agree to the collection, use and disclosure of personal information in accordance with our Privacy Policy.
ecoLiving may collect the data, information and documents essential for carrying out Energy Certification services. Such personal data and information are used exclusively for the purpose of carrying out the services requested by the user.
Users are solely responsible for the content and accuracy of any information provided by them. ecoLiving is not responsible for any error, omission, inaccuracy or falsehood in the information provided.
7. Responsibility throughout the process
The Qualified Expert is responsible for attending at the indicated property address, on the date and time agreed with the Client, who also should be present. If one of the parties is unable to do so, the other must be contacted immediately.
Any error, mistake or incorrect information provided when filling out the form is the responsibility of the Customer. The Customer is also responsible for sending the mandatory documents before the appointment date, otherwise the visit will not take place.
During the visit, the Qualified Expert surveys and records photographic construction elements and relevant technical systems, complying with current legislation. Access must be provided to all compartments of the property and to climatization and hot water production equipment.
The owner or his representative accompanying the visit must provide the Qualified Expert with the Declaration of the Energy Certification Process (DPCE), duly completed and signed, a document that is mandatory for submission on the ADENE portal.
After the visit and sending of the mandatory documents, the Qualified Expert issues the Energy Certificate in accordance with current legislation and sends the definitive document to the owner by email. The deadline for making the Energy Certificate available is from the date of the visit and receipt of the mandatory documents and payment.
8. Payment
Payment for Energy Certification services is made at the end of the online form filling process, after booking the site survey appointment.
Payment to be made via bank transfer.
The invoice/receipt for the payment will be sent to the Customer by email after payment confirmation.
9. No-show, Cancellation and Refunds
The Customer may cancel the service at any time up to 24 hours before the Qualified Expert’s visit is scheduled and the entire payment will be refunded. After this period, a fixed amount of €50 will be retained, with the remaining amount relating to the payment made being refunded.
In case of no-show at the property location at the agreed time (without prior notice up to 3 hours before), or failure to send the mandatory documents, a fixed amount of €50 will be withheld, with the remaining amount relating to the payment made being refunded.
If the Qualified Expert identifies, during the visit, a type of property different from that indicated by the Client on the form, the payment amount must be adjusted accordingly.

12. Termination
We reserve the right to terminate or suspend your access to the Website, without prior notice, for any reason or no reason at all.
13. Applicable Law and Jurisdiction
These Terms and Conditions are governed and interpreted in accordance with Portuguese law.
